Terms and Conditions

1. Definitions

In these Terms and Conditions, the following definitions apply:

• "Company," "We," "Us," "Our" refers to Foxomi, located at 12 Kensington Park Road, London, W8 7SE.
• "Customer," "You," "Your" refers to the individual or entity renting a motor boat from us.
• "Vessel" refers to any motor boat, watercraft, or related equipment provided by the Company.
• "Rental Period" means the agreed duration for which the Vessel is rented.

2. Booking and Reservations

All bookings must be made through our official website, by phone at +44 20 3487 9123, or via email at [email protected]. A valid booking confirmation will be sent upon receipt of payment or deposit.

Reservations are subject to availability. We reserve the right to refuse service or cancel bookings at our discretion, particularly in cases of safety concerns or violation of these terms.

2.1 Payment Terms

• A deposit of 30% is required at the time of booking
• Full payment must be received at least 48 hours before the rental period begins
• Accepted payment methods include credit cards, debit cards, and bank transfers
• All prices are quoted in GBP and include applicable taxes unless otherwise stated

3. Rental Requirements

To rent a motor boat from Foxomi, customers must meet the following requirements:

1. Be at least 21 years of age with a valid government-issued photo ID
2. Possess a valid boating license or demonstrate adequate boating experience
3. Provide a valid credit card for security deposit purposes
4. Sign our rental agreement and liability waiver before taking possession of the Vessel
5. Complete a safety briefing conducted by our staff

4. Use of Vessel

The Customer agrees to:

• Operate the Vessel in a safe, lawful, and responsible manner
• Comply with all maritime laws, regulations, and local ordinances
• Not operate the Vessel under the influence of alcohol or drugs
• Not exceed the maximum passenger capacity specified for the Vessel
• Not use the Vessel for commercial purposes without prior written consent
• Return the Vessel in the same condition as received, normal wear and tear excepted
• Not allow unauthorized persons to operate the Vessel

5. Cancellation and Refund Policy

We understand that plans may change. Our cancellation policy is as follows:

• More than 14 days before rental: Full refund minus 10% administrative fee
• 7-14 days before rental: 50% refund of total payment
• Less than 7 days before rental: No refund
• Weather-related cancellations: Full refund or rescheduling option if we deem conditions unsafe

6. Liability and Insurance

The Customer acknowledges that motor boat operation carries inherent risks. While we maintain comprehensive insurance on all our Vessels, the Customer is responsible for:

• Any damage to the Vessel caused by negligence, misuse, or violation of these terms
• Personal injuries sustained during the rental period
• Loss or damage to personal property
• Deductibles applicable under our insurance policy (typically £500-£1,500 depending on Vessel)

We strongly recommend that customers obtain personal travel and accident insurance.

7. Maintenance and Breakdowns

All Vessels are thoroughly inspected and maintained. In the event of mechanical failure not caused by Customer misuse, we will provide assistance or a replacement Vessel when possible. The Customer must immediately notify us of any mechanical issues at +44 20 3487 9123.

8. Security Deposit

A refundable security deposit is required for all rentals. The deposit amount varies based on the Vessel type and rental duration. The deposit will be returned within 7 business days after the Vessel is returned and inspected, provided there is no damage or violation of terms.

9. Limitation of Liability

To the maximum extent permitted by law, Foxomi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or Vessels. Our total liability shall not exceed the amount paid by the Customer for the rental.

10. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
